The work will be carried out by Andrew Gascoigne, who has over 30 years experience as a qualified solicitor.
This department not only prepares wills but also the now important Powers of Attorney with the emphasis on ensuring that our clients understand all the options before committing to them.
For probate matters we do not charge a percentage of the value of the estate. We only charge a fixed fee where given or our hourly rate for work actually carried out. Our charging rate is £195 plus £39 VAT per hour (£234 per hour including VAT). In addition, we would charge any disbursements actually incurred on your behalf including the probate application fee, advertisement fees or search fees, some of which are referred to below.
Our fee for a typical application for a Grant of Probate would be £650 plus VAT of £130 in the total of £780 on the following basis:-
. There is a valid Will
. There is no more than one property
. There are no disputes between beneficiaries or between named executors and if disputes arise this is likely to lead to an increase in costs
. There are no claims against the estate
. There is no inheritance tax payable and the executors do not need to submit a full account to HMRC
Typical disbursements would include:-
. Probate application fee of £155
. £7 oath fee (per executor)
If a full account is required to be delivered to HM Revenue and Customs the fee for obtaining Grant of Probate is likely to be in the order of £1,650 plus VAT of £330 in the total of £1,980.
In addition, the probate application fee of £155 would be payable and executor’s oath fee of £7 per executor.
As part of our fixed fee we would:-
. Identify the type of probate application that you require
. Complete all appropriate HMRC forms for your approval
. Prepare the executor’s oath for you to swear
. Make the application to the Probate Registry on your behalf
. Obtain the Probate and provide you with official copies
Typically where a full account does not have to be filed with the Revenue the work will take between 2-4 months. Where a full account has to be filed with the Revenue it will typically take between 3-6 months. The length of time will depend upon the complexity of the detail involved and the speed of response from third parties (such as Banks).
To instruct us to deal with the administration of the estate on your behalf, collect in and distribute the assets of the estate to the beneficiaries in accordance with your instructions the cost would depend upon the work involved but typically the fee would be in the order of £4,000 plus VAT of £800 (£4,800 including VAT)
